The government alleged he was a member of the MS-13 gang, but his lawyers disputed the claim and demanded his return to the U.S. The administration used the 1798 Alien Enemies Act to deport alleged gang members, including Venezuelans and Salvadorans, sparking legal challenges.
Abrego-Garcia’s family, who are U.S. citizens, called for his return, citing his detention in a “notorious torture chamber” in El Salvador.
The administration claimed it lacked the authority to bring him back, citing intelligence reports of his gang ties.
